Terms of Service

These terms explain the rules for using the Tuxy website, user accounts, and related services. By creating an account or signing in, you agree to follow them.

Account Use

You are responsible for the accuracy of the details you provide, the security of your account, and any activity that happens while signed in under your credentials.

User Responsibility

You are solely responsible for your actions, submitted content, account decisions, connected third-party services, and any outcome caused by your use or misuse of the platform. Responsibility for complying with laws, platform rules, contract obligations, and internal policies remains with you at all times.

Acceptable Use

  • Do not use the service for unlawful activity, abuse, fraud, harassment, or unauthorized access.
  • Do not attempt to bypass security controls, rate limits, account restrictions, or moderation actions.
  • Do not use the platform in a way that harms the service, other users, or connected systems.

Compliance With Laws and Third-Party Rules

You are responsible for ensuring your use of Tuxy complies with all applicable laws, regulations, third-party platform terms, API rules, hosting rules, workplace policies, and local restrictions that apply to your activity.

Records, Logs, and Evidence

Tuxy does not promise to create, capture, store, or preserve a complete record of every click, action, request, communication, event, device detail, or user workflow. Any logs, alerts, analytics, or security records that do exist may be partial, delayed, overwritten, summarized, sampled, unavailable, or removed according to operational needs.

Suspension and Termination

Tuxy may suspend, restrict, or permanently remove access to accounts that violate these terms, create operational risk, or threaten the security of the service.

No Duty to Monitor or Prevent User Conduct

Tuxy may monitor, log, review, limit, or remove activity for safety and operations, but it is not required to actively supervise every user action, submission, or connected workflow. Failure to detect or stop user conduct does not shift responsibility away from the user who caused it.

No Duty to Retain or Produce Data

Except where required by applicable law after a valid and binding legal obligation applies, Tuxy has no duty to retain data for any fixed period, preserve material for future disputes, or maintain records for the benefit of users, third parties, investigators, or private claimants. If data was never collected, is no longer retained, or is outside Tuxy's possession or control, Tuxy may be unable to provide it.

Indemnification

You agree to defend, indemnify, and hold Tuxy harmless from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal costs, arising out of your account, your conduct, your submitted content, your breach of these terms, or your violation of any law or third-party right.

No Warranty

The service is provided on an as-available basis. We do not promise uninterrupted availability, perfect accuracy, or fitness for any particular purpose.

Legal and Government Requests

Tuxy may review, narrow, challenge, reject, or comply with legal, regulatory, or government requests only to the extent required by applicable law and operationally feasible in the circumstances. Tuxy does not guarantee that it will possess responsive data, that retained information will be complete, or that any request can be fulfilled in whole or in part.

Limitation of Liability

To the maximum extent permitted by law, Tuxy and its operators are not liable for indirect, incidental, special, punitive, consequential, or third-party damages, or for loss of profits, data, access, reputation, or business opportunity, arising from or related to your use of the service. Any direct liability that cannot be excluded is limited to the smallest amount allowed by applicable law.

Changes

These terms may be updated over time. Continued use of the service after changes are published means you accept the updated version.
